Town of Croghan Public Hearing – Moratorium Town Board Meeting 05-20-2024

The Meeting of the Town Board of the Town of Croghan, County of Lewis and the State of New York was held at the Town Municipal Building, 9882 State Route 126 Beaver Falls, on the 20th day of May, 2024.

Richard Meyer, Councilmember

Kevin Zehr, Highway Superintendent

Megan E. Simpson, Clerk

 

Attended by:  21 Individuals

 

Supervisor Boliver called the meeting to order at 6:00pm with the Pledge of Allegiance.

 

 

RESOLUTION NO. 53 OF 2024

OPEN PUBLIC HEARING ON MORATORIUM, PROPOSED LOCAL LAW 1 OF 2024

On a motion by Councilmember Meyer, seconded by Councilmember Hamlin-Boliver, the following resolution was

ADOPTED       Ayes (5) Boliver, Hamlin-Boliver, Hardy, Meyer, Virkler    Nays  (0)

 

RESOLVED, the public hearing was opened at 6:01pm.

 

 

There was a discussion on how a moratorium is lengthy and costly and whether it’s necessary to implement a moratorium or simply move forward with updating the zoning law without a moratorium.

On a motion by Councilmember Hamlin-Boliver, seconded by Councilmember Virkler, the following resolution was

RESOLVED, the public hearing was closed at 6:40pm.

RESOLUTION NO. 56 OF 2024

APPROVAL OF MINUTES

On a motion by Councilmember Hamlin-Boliver, seconded by Councilmember Meyer, the following resolution was

ADOPTED       Ayes (5) Boliver, Hamlin-Boliver, Hardy, Meyer, Virkler    Nays  (0)

 

RESOLVED, the minutes of the April meeting are approved.

 

 

PRIVILEGE OF THE FLOOR

Legislator Kalamas updated the Board on the happenings within the County.  He presented the Board with information on working with the County for a new website and .gov email addresses.

Gary Goldthrite was present to ask Supervisor Boliver to sign his site plan for the new storage building on his property.

Erin Hardy was present to discuss her frustration with her assessment of the Buckhorn Bar and Grill.  Council Member Hardy handed out information that Ms. Hardy had prepared.  Council Member Hardy also voiced his concern to Assessor Smith.  Assessor Smith explained the changes and also the steps the Hardy’s should take to file a grievance.

RESOLUTION NO. 57 OF 2024

APPROVAL TO MOVE FORWARD WITH REVALUATION FOR THE 2025 TAX ROLL

On a motion by Councilmember Hamlin-Boliver, seconded by Councilmember Hardy, the following resolution was

ADOPTED       Ayes (4) Boliver, Hamlin-Boliver, Hardy, Virkler     Nays  (1)   Meyer

 

RESOLVED, the Board will move forward with a revaluation for the 2025 tax roll.

 

 

FINANCIAL REPORT

Supervisor Boliver reported the following as of April 30, 2024:

 

Community Bank Checking: $46,842.45

Community Bank Savings: $28,558.68

NYClass Checking: $1,629,867.19

NYClass Savings: $323,254.31

Total: $2,029,197.63

 

 

RESOLUTION NO. 58 OF 2024

APPROVAL OF FINANCIAL REPORT

On a motion by Councilmember Meyer, seconded by Councilmember Hamlin-Boliver, the following resolution was

ADOPTED       Ayes (5) Boliver, Hamlin-Boliver, Hardy, Meyer, Virkler          Nays (0)

 

RESOLVED, the financial report is approved as submitted.

 

 

RESOLUTION NO. 59 OF 2024

TRANSFER OF FUNDS

On a motion by Councilmember Hardy, seconded by Councilmember Virkler, the following resolution was

ADOPTED       Ayes (5) Boliver, Hamlin-Boliver, Hardy, Meyer, Virkler        Nays (0)

 

RESOLVED, from the fund balance, $44.86 to 1110.42 to Contractual – Justice Court.

 

 

 

HISTORIAN REPORT

Nick reported he and Laurie have been working on recent requests and researching areas within the Town. They are looking into having the Jerden Falls tour in the Fall and having a display at the Municipal Building.

 

 

TOWN CLERK

Megan reported the following for April 2024:

Total:  $295.00

Town Share:  $273.00

NYS Ag & Mkts:  $22.00

On a motion by Councilmember Virkler, seconded by Councilmember Meyer, the following resolution was

ADOPTED       Ayes (5) Boliver, Hamlin-Boliver, Hardy, Meyer, Virkler        Nays (0)

 

RESOLVED, the Clerk report is approved as submitted.

 

 

TAX COLLECTION

Megan stated since January 1st 2024 the total amount collected is $3,159,948.54 which is approximately 72% of the total to be collected. In the beginning of April, 401 late tax notices were mailed to land owners.

On a motion by Councilmember Meyer, seconded by Councilmember Hardy, the following resolution was

ADOPTED       Ayes (5) Boliver, Hamlin-Boliver, Hardy, Meyer, Virkler              Nays (0)

 

RESOLVED, the Tax Collection report is approved as submitted.

HIGHWAY

Superintendent Zehr stated two crews have been picking up sand. The new tractor has arrived.

 

NEW BUSINESS

Clerk Simpson stated that AES would like the Sugar Maple Solar Community Meeting posted to the Town’s website.  The Board is ok with Megan posting the meeting online

 

 

SUPERVISOR REPORT

Supervisor Boliver stated his communications at various times throughout the meeting.

APPROVAL OF SUPERVISOR REPORT

On a motion of Councilmember Hardy, seconded by Councilmember Meyer the following resolution was

ADOPTED       Ayes (5) Boliver, Hamlin-Boliver, Hardy, Meyer, Virkler        Nays (0)

 

RESOLVED, the Supervisor’s report is approved as submitted.

 

 

RESOLUTION NO. 63 OF 2024

AUDIT OF CLAIMS

On a motion of Councilmember Hardy, seconded by Councilmember Meyer the following resolution was

ADOPTED       Ayes (5) Boliver, Hamlin-Boliver, Hardy, Meyer, Virkler       Nays (0)

 

RESOLVED, Supervisor Boliver is authorized and directed to pay on Abstract 05 of 2024 in the following amounts:

 

General                          Vouchers 45-50                    $5,738.75

Highway                         Vouchers 42-45                    $4,929.29

BF Sewer                       Voucher 8-10                         $1,758.01

The next regular meeting will be on June 17, 2024 at 6pm.

 

With no further business, on a motion by Councilmember Meyer, seconded by Councilmember Virkler, the meeting adjourned at 8:56pm. Carried unanimously.
